Agape Baptist Church Staff – Round Up of Litigation

Dr. David Smock – Former Agape Physician & Doctor at Stockton Lake Walk-In Clinic

In Greene County, David Smock is currently facing charges of:

  • Child Molestation – 3rd Degree – Child Less than 14 Years Old
  • Statutory Sodomy Or Attempted Statutory Sodomy – Deviate Sexual Intercourse – Person Less Than 14 Yoa 
  • Enticement Or Attempted Enticement Of A Child (Actor 21 Yrs Of Age Or Older And Child Less Than 15 Yrs Of Age)

The Pre-Trial Conference for these charges is scheduled for November 29th, 2022.

In Cedar county, Smock is facing 12 separate charges:

  • Sexual Misconduct Involving A Child Under 15 – 1st Ofns
  • Statutory Sodomy Or Attempted Statutory Sodomy – Deviate Sexual Intercourse – Person Less Than 14 Yoa 
  • Statutory Sodomy Or Attempted Statutory Sodomy – Deviate Sexual Intercourse – Person Less Than 14 Yoa
  • Statutory Sodomy Or Attempted Statutory Sodomy – Deviate Sexual Intercourse – Person Less Than 14 Yoa {
  • Statutory Sodomy Or Attempted Statutory Sodomy – Deviate Sexual Intercourse – Person Less Than 14 Yoa
  • Atmp-Statutory Sodomy – 2nd Degree
  • Child Molestation – 4th Degree – Child Less Than 17 Yoa And Offender Greater Than 4 Years Older
  • Stalking – 1st Degree – L/E Or Relative
  • Statutory Sodomy Or Attempted Statutory Sodomy – Deviate Sexual Intercourse – Person Less Than 14 Yoa
  • Sexual Misconduct Involving A Child Under 15 – 1st Ofns
  • Enticement Or Attempted Enticement Of A Child (Actor 21 Yrs Of Age Or Older And Child Less Than 15 Yrs Of Age)
  • Statutory Sodomy Or Attempted Statutory Sodomy – Deviate Sexual Intercourse – Person Less Than 14 Yoa 

There is not currently a hearing scheduled regarding these charges. There is a chance that there will be a change of venue, although that has not been decided yet. The charges are currently with Cedar County.

Everett Graves – Former Staff

Everett Graves, former Agape Staff, has been charged in Cedar County with Assault in the 3rd Degree. On Wednesday, November 2022, there will be a case review in Cedar County with Judge Thomas Pyle at 1:30pm.

On Thursday, December 8th, 2022 a preliminary hearing will be held at the Cedar County Courthouse at 1:30pm with Judge Thomas Pyle.

Graves is being represented by Craig Heidemann and Jacob Spindler of Bolivar, Missouri.

Everett Graves is the brother of Robert Graves, current Cedar County Deputy and former Agape student.

Seth Duncan – Former Staff

Seth Duncan has been charged with five separate counts of Assault in the 3rd Degree in Cedar County. The preliminary hearing for this case has been scheduled for December 14th, 2022 at 1:30pm at the Cedar County Courthouse with Judge Thomas Pyle.

Seth is being represented by Stacie Bilyeu of Springfield. At the time these charges were filed, Duncan was 21 years old and living at an address owned by “Smock Residential Rentals LLC.”

Trent Hartman – Former Staff

Trent Harman was charged with two counts of Assault in the 3rd Degree. A Case Management Conference is scheduled for December 12th, 2022 at 9:00am at the Cedar County Courthouse with Judge David Munton.

Christopher McElroy – Former Staff

Christopher McElroy was charged with one count of Assault in the 3rd Degree. There is a Case Review scheduled for November 2nd at 1:30pm at the Cedar County Courthouse with Judge Thomas Pyle. The preliminary Hearing is scheduled for December 8th at 1:30pm at the Cedar County Courthouse with Judge Thomas Pyle.

Dumar is being represented by Craig Heidemann and Jacob Spindler of Bolivar, Missouri.

Scott Dumar – Medical Coordinator

Scott Dumar, the former Medical Coordinator for Agape, was charged with four counts of Assault in the 3rd Degree. There is a Case Review scheduled for November 2nd at 1:30pm at the Cedar County Courthouse with Judge Thomas Pyle. The preliminary Hearing is scheduled for December 8th at 1:30pm at the Cedar County Courthouse with Judge Thomas Pyle.

Dumar is being represented by Craig Heidemann and Jacob Spindler of Bolivar, Missouri.

Scott Dumar is also listed in a Civil Suit filed by John Doe I. The defendants are listed as Agape Baptist Church, James L Clemensen, Frank Burton, Robert Graves, Tim Cleveland, Kathy Clemensen, and of course Scott Dumar. The suit was originally filed in Cedar County but was moved in April 2021 to Vernon County.

There will be a Pre-trial Conference held on February 22nd 2023 at 9:00am at the Vernon County Courthouse. The trial for this case is set to begin on March 20th, 2023 and is scheduled for up to five days.

Julio Sandoval – Former Dean of Students

According to a Press Release from the U.S. Attorney’s Office Eastern District of California, Julio Sandoval has been arrested for participating in a scheme that transported a minor from California to Missouri.

Julio Sandoval and Shana Gaviola face a maximum statutory penalty of five years in prison and a $250,000 fine for the charge of Interstate Violation of a Protection Order and Aiding and Abetting.

Julio Sandoval is the former dean of students at Agape Boarding School in Stockton Missouri.

Julio Sandoval is the current owner of the non-profit Safe Sound Secure Ministries, registered in the state of Missouri.

Julio Sandoval is on the Board of Directors at ABM Ministries, also known as Lighthouse Christian Academy, ABM Family Preparatory, or Christ Community Church in Piedmont, Missouri.
